OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANGE OF WINNING. VOID WHERE PROHIBITED BY LAW. Open to legal residents of all 50 Unites States and Washington, D.C., who are 18 years of age or older as of the date of entry.

The Sponsor of the Sweepstakes is Kum & Go, L.C., an Iowa Limited Liability Company located at 1150 Locust Street, Suite 301, Des Moines, IA 50309. Kum & Go, L.C., their subsidiaries, and affiliated companies (collectively referred to hereinafter as either the (“Company” or “Sponsor”)) will conduct the Customer Satisfaction Survey Sweepstake (hereinafter the “Sweepstakes”). By participating, participants agree to these Official Rules,

  1. Description of Sweepstake. Participants who complete the Customer Satisfaction Survey will have the chance to win one (1) $50 Kum & Go Gift Card, (“Prize”). At least one (1) Prize will be awarded each month. Actual Retail Value (“ARV”) of each Prize is approximately $50.00.

  2. Sweepstakes Period: The Sweepstake will begin on or about 12:01 AM MST/MDT on the first day of each month (“Sweepstake Start Date”) and end on or about 11:59 PM MST/MDT the final day of each month (“Sweepstake End Date”). Sponsor may terminate these Sweepstakes at any time at its sole discretion.

  3. How to Enter: In order for the Participant to submit a valid Sweepstakes entry, Participants may enter Sweepstakes by any of the following two (2) ways:

    A. Purchase. Entrants making a purchase (of any amount) at a participating Kum & Go retail location during the Sweepstakes period may receive an invitation on their receipt to go online to complete a survey (“survey”). By completing the survey each completed survey will receive one (1) entry into the Sweepstakes. Survey must be completed by 11:59:59pm MST/MDT on the final day of each month to qualify for draw date for that month. Limit one entry per person/email address.

    B. Mail. To enter without making a purchase, legibly handwrite on a 3” X 5” card (“Mail-in Entry”) your complete name, mailing address, phone number and date of birth and mail with proper postage to Customer Satisfaction Survey, ATTN: Sweepstakes Entry/Mail-in Entry, Maverik, Inc. 185 S. State Street, Suite 800, Salt Lake City, UT 84111. All Mail-in entries must be postmarked by the last day of the sweepstakes month and received by the 8th day of the month following the sweepstakes month. There is a limit of one (1) mail-in entry per envelope and each envelope shall be individually postmarked. Each eligible Mail-in Entry is considered one (1) entry into the Sweepstakes. Limit one entry per person per monthly Sweepstakes. No mechanical reproductions will be accepted. Mail-in entries must contain all entry fields outlined above; otherwise, they are void and will not be eligible to win.

    NO AUTOMATED ENTRIES: Auto entries prohibited. You must fill out your own entry form without the use of any automated sweepstakes entry filling services or form filling services. The use of any automated, programmed, robotic or similar system to enter is prohibited and will result in disqualification. Entries filled out by anyone other than you will be disqualified.

    LIMIT ON ENTRIES: Limit of one (1) entry per person/email address no matter how many Customer Satisfaction Survey’s are completed by entrant during each monthly Sweepstakes period and limit of one (1) Mail-in Entry during each monthly Sweepstakes period, as defined herein.

  4. Prize Details: There will be ten (10) Prizes awarded pursuant to this Sweepstakes. The Prize will consist of the following:

    A. $50.00 Kum & Go Gift Card (“Prize”)

The Approximate Retail Value (“ARV”) of each Prize is $50.00

IN ORDER TO RECEIVE THE PRIZE, THE WINNER MUST SIGN AN OFFICIAL AFFIDAVIT AND RELEASE FORM PROVIDED BY THE COMPANY. NO PRIZE WARRANTY. WITHOUT LIMITING THE FOREGOING, ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.

  1. Eligibility, and Limitations: All mail must be postmarked within the Sweepstakes Period and received by 12:00 PM MST/MDT on the 8th day of the month following the sweepstakes month. Participants and winner(s) must be legal U.S. residents and at least 18 years of age or older as of the date of entry. Employees of the Company or its affiliates, the Sweepstakes participating sponsors and their advertising agencies, employees of radio or television stations advertising or promoting the Sweepstakes, and members of the immediate family of any such persons are not eligible to participate and win.

    The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.

  2. Winner Selection: The Prize winner will be selected in a random drawing to be held on or about the 8th day of each month of the Sweepstakes Period. Drawing will be conducted by Sponsor, whose decisions are final on all matters relating to the drawing. Sponsor will notify the Prize winner by phone or email on or about five (5) business days following the applicable drawing date. If after three (3) attempts by email or phone during a forty-eight (48) hour time period (as determined by Company in its sole discretion) the Company is unable to contact the Prize winner, the prize will be forfeited, and an alternate winner will be selected by random drawing from all remaining eligible entries. Winner hereby accepts and agrees to these rules, acknowledges, and affirms that they meet the Sweepstakes rules’ eligibility requirements, agrees to the publicity/liability set forth below, and agrees to sign and return to Company an Affidavit and Release form provided by Company no later than five (5) days after being notified that they are the potential winner, or the prize will be forfeited. An alternat winner for the prize may be selected at Company’s sole discretion.

  3. Decisions: By participating in the Sweepstake, participants agree to be bound by the decisions of Company personnel. Company reserves the right to disqualify any participant or winner and may refuse to award any prize to a person who is ineligible or who Company believes has violated any rule, gained unfair advantage in participating in the Sweepstake, or obtained winner status using fraudulent means. Company will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Sweepstake and the Company’s decisions concerning such disputes shall be final. If the conduct or outcome of the Sweepstake is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference, or any event beyond the control of the Company, Company reserves the right to terminate this Sweepstake, or make such other decisions regarding the outcome as Company deems appropriate. All decisions will be made by Company and are final. Company may waive any of these rules in its sole discretion.

  4. Prize Odds: The estimated odds of winning the Prize during the Sweepstakes period will be dependent on the number of eligible entries received/postmarked during the Sweepstakes Period.

  5. Prize Restrictions: No cash redemptions. No transfer of Prize permitted. No substitutions, except Sponsor may substitute a prize of equal or greater value at its sole discretion. All costs not specifically stated herein as being awarded are the sole responsibility of the Prize winner.

PRIZE NOTIFICATION: Winner will be notified by email or phone on or about five (5) business days of the drawing date. If after three (3) attempts by email or phone during a forty-eight (48) hour time period (as determined by Company in their sole discretion) if the company is unable to contact the winner, prize will be forfeited and an alternate winner will be selected. Winner by accepting these rules, acknowledges and affirms that they meet the Sweepstake rules’ eligibility requirements and agree to the publicity/liability set forth below or prize will be forfeited. An alternate winner for forfeited prizes may be selected at sponsor’s sole discretion.

  1. Taxes: Any valuation of the prize(s) stated above is based on available information provided to the Company, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize that are not specifically provided for in the official rules. Each winner must provide the Company with valid identification, mailing address, and a valid taxpayer identification number or social security number before any prize will be awarded. Prizes are not transferable, redeemable for cash or exchangeable for any other prize. Any person winning over six hundred dollars ($600.00) in prizes may receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

  2. Winner’s List: To obtain a list of the Prize winner, one must mail a self-addressed stamped envelope to Winner’s List Address below. Mail must be received by the Winner’s List Request Deadline of no later than 12:00 PM noon MST/MDT on the 20th day of the month following the sweepstakes month you are requesting information about. A list will be sent once all prizes have been awarded. Winner’s List Request must be addressed to: Customer Satisfaction Survey/Winners List Request, ATTN: Sweepstakes Entry, Maverik, Inc. 185 S. State Street, Suite 800, Salt Lake City, UT 84111.

  3. Publicity; Use of Personal Information: Except as otherwise prohibited by law, Sponsor may collect personal data about participants when they enter the Sweepstakes and/or claim the Prize. Personal data includes: first and last name, address, email address, daytime phone number(s), and any personal data included in the information transmitted to Sponsor in connection with the Sweepstakes. Please review Company’s privacy policy at https://kumandgo.com/privacy-policy/ . By participating in the Sweepstakes, participants hereby grant to Sponsor an irrevocable right, without further compensation, to use the information, photographs, and personal data provided to Sponsor, singularly or in conjunction with information, photographs, and personal data provided to Sponsor, singularly or in conjunction with information, photographs, and personal data provided by other participants, for advertising, publicity, commercial or other business purposes. Participants further hereby release Sponsor, their affiliates, employees, and officers from any liability whatsoever relating to Sponsor’s use of information, photographs, or other personal data provided to Sponsor by entrant in connection with their entry in the Sweepstakes.

  4. Compliance with Law: The conduct of the Sweepstakes is governed by the applicable laws of the Unites States of America and the local or state jurisdictions in which the Sweepstakes is eligible, which take precedence over any rule to the contrary herein. Company shall follow the applicable laws for conducting Sweepstakes, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, providing specific written information about the Sweepstakes, etc. as required by local and state law.

  5. Governing Law and Venue: The laws of the State of Utah, excluding the rules of conflicts of law, shall govern this and all matters arising out of or related to this Sweepstake. The parties, including Sweepstake winners, hereby submit to the jurisdiction of the state or federal courts located in Salt Lake County, Utah. Each party expressly agrees that it is subject to the jurisdiction and venue of those courts for purposes of such litigation. Each party hereby waives and covenants not to assert any claim that is not subject to personal jurisdiction in those courts or that venue in those courts is for any reason improper, inconvenient, prejudicial or otherwise inappropriate (including, without limitation, any claim under the judicial doctrine of forum non convenient).

  6. Miscellaneous: Company may substitute prizes, amend the rules or discontinue the Sweepstake at any time. Company disclaims any responsibility to notify participants of any aspect related to the conduct of the Sweepstake. Written copies of these rules are available by mail with written request with a stamped, self- addressed return envelope at addressed to Customer Satisfaction Survey/Winners List Request, ATTN: Sweepstakes Entry, Maverik, Inc. 185 S. State Street, Suite 800, Salt Lake City, UT 84111, or may be read on this website https://www.maverik.com. All entries become the property of Company and will not be returned.

RELEASE OF LIABILITY: IN ORDER TO RECEIVE A PRIZE, WINNERS MUST SIGN AN OFFICIAL WAIVER FORM PROVIDED BY THE COMPANY.

BY ENTERING OR PARTICIPATING IN THE SWEEPSTAKE, EACH ENTRANT, PARTICIPANT OR WINNER AGREE THAT IN NO EVENT WILL KUM & GO, L.C.., SPONSORS, SWEEPSTAKE PARTIES, SWEEPSTAKE PROVIDERS AND ALL THEIR RESPECTIVE DIRECTORS, OFFICERS, SHAREHOLDERS, OWNERS, AGENTS, AFFILIATES, SUBSIDIARIES, EMPLOYEES, OR ANY OTHER SPONSOR OR PROVIDER (COLLECTIVELY “RELEASEE(S)”) BE RESPONSIBLE OR LIABLE FOR, AND YOU HEREBY RELEASE THEM FROM, ANY AND ALL CLAIMS, ACTIONS, DAMAGES, LOSSES, COSTS, EXPENSE OR LIABILITY OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, PROPERTY DAMAGE, PERSONAL INJURIES AND/OR DEATH, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, AND COUNSEL FEES AND COURT COSTS) ARISING OR RESULTING FROM ANYTHING RELATING TO:

THE PRODUCTION, PROMOTION, ADMINISTRATION OR EXECUTION OF THE SWEEPSTAKE (OR YOUR PARTICIPATION IN IT); CANCELLATION, MODIFICATION OR RESCHEDULING OF ANY ASPECT OF THE SWEEPSTAKE; OF ANY WEB SITE(S) RELATED TO THE SWEEPSTAKE OR MATERIALS ON THE WEB SITE; ACCEPTANCE, POSSESSION, USE, MISUSE, OR NONUSE OF THE PRIZE; OR PARTICIPATING IN OR TRAVELING TO ANY SWEEPSTAKE-RELATED ACTIVITY.

LIMITATIONS: Neither Company nor any other Releasees are responsible for: lost, late, damaged, incomplete, illegible, stolen, misdirected, or postage due mail, shipping or email; any website, computer, telephone, satellite, cable, network, Internet or other equipment, electronics, software, service, transmission, connection, processing or other errors, failures, congestion, accessibility or availability issues; unauthorized access, tampering, hacking, theft or destruction; or other technical or human error in the receipt or processing of entries, game piece requests or other submissions (whether to or from) or otherwise related to the production, promotion, administration or execution of the Sweepstakes.

TAMPERING/VIOLATIONS/DISRUPTION: Company may, in its sole determination, disqualify any person it believes may be tampering with the entry or other operation of the Sweepstake or acting in violation of the rules, in a non-sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person.

CAUTION: ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON OR ENTITY TO THE FULLEST EXTENT PERMITTED BY LAW.

CANCELLATION/MODIFICATION: Company may, in its sole discretion, cancel, terminate, modify or suspend the Sweepstake if the Sweepstake is not capable of running as Company planned for any reason (including, but not limited to, due to tampering, unauthorized intervention, computer virus, fraud, technical or human error or any other causes which Company, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity or intended conduct of this Sweepstakes).
